However, you did mention a few outstanding examples (Prof. Tripathi, etc.). Are there any similar pieces that you have come across in more recent academic literature?<BR/>In my opinion, Chief Justices (and Supreme Court justices generally) are men of considerable ability. And I'm not just talking about legal acumen. Unlike the United States, where it is somewhat uncertain as to who the next appointment to the Court is going to be, who the CJI of India will be in 2010 is already decided. for that matter, by looking at the pools of judges in individual High Courts, we also know who is going to be the CJ of that High Court. One can perhaps also figure out which judges might have a future in the Supreme Court, albeit without exactitude (assuming they don't rub their elders in the SC the wrong way). To work their way up must require considerable planning and strategem.<BR/>I would also go out on a limb abd say that perhaps you are being a little too harsh on Lahoti, CJ. His outbursts against the executive were unnecessary. <BR/>Of late, I've found the Supreme Court entering unchartered waters; the Jharkhand issue was a case in point. May be Chief Justice Lahoti would have done better to put his "house" in order rather than take on another arm of government.
