A Blog About India's Laws and Legal System, its Courts, and its Constitution
This seems like a large loophole and worth debating and correcting. Otherwise I fear either Parliament will abuse its power to stack the JAC when it wants to push back on the judiciary or the judiciary out of fear of this outcome will read down the amendment so that we are in a similar position to which we now find ourselves. Neither position is desirable and both seem avoidable.
